Wire fraud and email compromise are ongoing threats in real estate closings. Praxis will never send you wiring instructions, or a change to previously issued wiring instructions, by unsecured email. Before sending any funds, call your Praxis closer at a phone number you have independently verified (not one provided in an email) to confirm the wiring instructions and the receiving account. Do not rely on phone numbers, email addresses, or wiring information contained in any email purporting to be from Praxis without independent verification.

We collect personal information that you voluntarily provide to us or that is collected automatically when you express an interest in obtaining information about us or our Services, when you participate in activities on the Services, or otherwise when you contact us or engage us for a real estate closing, title, or escrow transaction.

Personally Identifiable Information (“PII”) and Nonpublic Personal Information (“NPI”) you disclose to us.

The personal information we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. In connection with our title, closing, and escrow Services, the personal information we collect is governed in part by the Gramm-Leach-Bliley Act (“GLBA”) and applicable state law (including the Texas Insurance Code for Texas transactions) and may be treated as nonpublic personal information (“NPI”). Non-Personally Identifying Information (“Non-PII”) automatically collected.

• sales and marketing tools

• accounting, audit, and tax advisors

We also may need to share your personal information in the following situations:

Affiliates. Praxis does not share your nonpublic personal information with our affiliates for their own marketing or everyday business purposes, except as described in the GLBA Privacy Notice in Section 6 below. If we share any personal information with an affiliate, we will require that affiliate to honor this Privacy Policy.

Legal Obligations. We may disclose information you provide, including your PII and NPI, if required to do so by law or if we believe, in our sole discretion, that disclosure is reasonably necessary to: (a) comply with federal, state, or local law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law); (b) protect or defend us or a third party’s rights or property; (c) protect someone’s health or safety, such as when harm or violence against any person is threatened; or (d) prevent fraud.

Aggregate Information. We may share aggregate or de-identified information that does not identify any individual with third parties for industry analysis, demographic profiling, and other purposes.

The Website may contain links to third-party owned or operated websites. We are not responsible for the privacy practices or the content of such websites. Title V of the Gramm-Leach-Bliley Act (“GLBA”) generally requires financial institutions to explain how they share and protect your personal information. In compliance with the GLBA, this section describes the privacy policies and practices of Praxis with respect to nonpublic personal information (“NPI”) collected in connection with your real estate transaction. Federal and applicable state law and regulations (including the Texas Insurance Code for transactions involving Texas property) give consumers the right to limit some but not all sharing.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, title insurance underwriting, real estate recordkeeping, or other legal requirements). Title and closing files are typically retained for the periods required by applicable state law and our title insurance underwriters, which can exceed seven (7) years.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We have implemented appropriate and reasonable technical, administrative, and organizational security measures designed to protect the security of any personal information we process, including measures designed to comply with the GLBA Safeguards Rule and applicable state information security laws. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk.

The safety and security of your information also depends on you. Where we have given you (or you have chosen) a password or other credentials for access to certain parts of the Website or Services, you are responsible for keeping those credentials confidential. We ask you not to share your password with anyone. As noted in the Wire Fraud Warning above, always verify wiring instructions by phone using a number you have independently confirmed before transmitting any funds.

All PII and NPI that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

We do not knowingly solicit data from or market to children under 13 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 13 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. Withdrawing your consent. Texas-specific rights and disclosures. If you are a Texas resident, you may have rights under the Texas Data Privacy and Security Act (“TDPSA”), subject to the GLBA and other exemptions noted above. In addition, Praxis Title & Escrow of Texas LLC is regulated by the Texas Department of Insurance (“TDI”) and handles nonpublic personal financial and health information about Texas consumers in accordance with Title 28 of the Texas Administrative Code, Chapter 22 (Privacy of Consumer Financial and Health Information). Texas consumers have the right to know what nonpublic personal information Praxis Title & Escrow of Texas LLC collects about them, the categories of persons to whom it may be disclosed, and the right to access and correct certain information in our records, subject to applicable exceptions. Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals. However, as noted above, we do honor valid Global Privacy Control (GPC) signals where required by applicable law.

Under applicable law, you or someone legally authorized to act on your behalf (your “authorized agent”) may make a request to access, correct, or delete your PII, subject to the GLBA and other exemptions described in Section 11 above.
